These Official Rules & Regulations govern the conduct of the raffle and, together with the decisions of THE MAP FOUNDATION, INC (hereinafter “MAP Foundation”), are binding on everyone who purchases a raffle ticket and/or who is named on a raffle ticket. The Lexus for the Little Ones 2020 Raffle of a 2020 Lexus ES 350 is a fundraising activity conducted by MAP Foundation in support of KENTUCKY CHILDREN’S HOSPITAL AND WOODHILL COMMUNITY CENTER. These Official Contest Rules may not be waived, modified or supplemented unless such waiver, modification or supplementation is made in writing by MAP Foundation.
GRAND PRIZE DRAWING
The Grand Prize drawing for the Lexus for the Little Ones 2020 Raffle of a 2020 Lexus ES 350 will be held on Sunday, March 8, 2020 during the 7th Inning Stretch of the UK vs. Bradley baseball game at Kentucky Proud Park, 510 Wildcat Court, Lexington, KY 40506. The game begins at 1:00 p.m. You need not be present to win. Each raffle ticket holder who shows their ticket will receive one free admission to the game. Visit the Lexus for the Little Ones table near Will Call at the Home Plate Entrance to get your ticket. If the game is canceled due to weather conditions, the drawing will take place at Kentucky Proud Park, Sunday, March 8th at 3:30 p.m. This date and all other dates stated in these rules may be extended at the absolute discretion of MAP Foundation. In the event the raffle is postponed, all reasonable efforts will be made to notify ticket holders of the new drawing date. Ticket requests by mail, email or on line must be received before 5:00 PM EDT Friday, March 6, 2020. Tickets may sell out before that time. The drawing will be conducted under the supervision of MAP Foundation. The winning ticket will be drawn at random from a drum containing all eligible raffle tickets. The drawing for the car is open to the public, and the winner does not need to be present to win.
The price per ticket is $100.00. A maximum of 2,000 tickets will be sold. Ticket sales will cease when the maximum number of qualified entries is reached. Any requests and payments received following the cut off time or after the sale of 2,000 tickets will be returned to the sender. If fewer than 2,000 raffle tickets are sold, MAP Foundation reserves the right, in its absolute discretion, to postpone the date of the drawing until a date that is within seven (7) days from the date on which the maximum 2,000 tickets have been sold. If fewer than 2,000 raffle tickets are sold, online sales will cease at 5:00PM on March 6th, 2020. The ratio of prizes to tickets is a maximum of 1 to 2,000 if all tickets are sold. Employees, Directors, and Officers of The MAP Foundation, Inc., are not eligible to participate.
MAP Foundation does not undertake to give advice on the legal or tax consequences of the raffle or its winner. However, it understands that the IRS position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and, consequently, do not qualify as deductible charitable contributions.
The Grand Prize winner assumes and must pay all fees and charges (including, but not limited to, tags, tax and license), income taxes, local, state and federal taxes when the car is transferred to the winner. In addition, all costs of car ownership, such as (without limitation) insurance, are the Grand Prize winner's sole responsibility. MAP Foundation assumes no responsibility for The Grand Prize winner's tax obligations and suggests you consult your tax advisor. Forms W-2G & 941 will be filed with the Internal Revenue Service to report the value of the prize won. The winner will also receive a copy of these forms. This offer is void where prohibited by law; and all federal, state and local laws and regulations apply.
The Grand Prize winner is strongly advised to seek professional legal or tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner, including, without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. The Grand Prize is a 2020 Lexus ES 350 to be purchased at Lexus of Lexington, Lexington, Kentucky. Depictions of the car shown in informational materials on the Internet can be found on www.lexusoflexington.com and elsewhere. The 2020 Lexus ES 350 shown in photos may be only representative of the Grand Prize; actual cars may be viewed at Lexus of Lexington, 1264 E. New Circle Road, Lexington, Kentucky 40505, and various Lexus and Kentucky Children’s Hospital events during the year.
By participating in this raffle, all ticket purchasers and the person named on each raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by MAP Foundation for publicity purposes and naming of the prize winner to be published in area newspapers or other media including television, radio, web and print. The Grand Prize winner will be published on Lexus of Lexington, Kentucky Children’s Hospital, and Woodhill Community Center websites. The name of the winner may be obtained by sending a written request plus a self-addressed, stamped envelope to The MAP Foundation, Inc., 1999 Richmond Road, Suite 300, Lexington, KY 40502. MAP Foundation’s interpretation and application of the rules and regulations shall be final.
By participating in this raffle, each participant releases MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, and Woodhill Community Center and each of their respective members, directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind, including, but not limited to, liability for injuries, losses, or damages arising from or caused by any prize or resulting from acceptance, possession, use or misuse of any prize; and each winner agrees to indemnify and hold MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, and Woodhill Community Center and each of their respective members, directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of any prize.
Raffle is open to the general public, and ticket purchasers and the person named on a raffle ticket must be at least 18 years of age at the time of purchase. Prize winners may be required to sign an affidavit of eligibility. Employees, Directors and Officers of The MAP Foundation, Inc., are not eligible to participate. Offer void where prohibited by law.
In order for the Grand Prize winner to receive the car (subject to the other provisions in these rules), the Grand Prize winner must elect to receive the car by delivering written notice of that election to MAP Foundation, by 1:00 PM on April 9, 2020. If the winner is not present at the drawing, MAP Foundation shall notify the winner by certified mail within seven (7) days of the drawing that the winner shall claim the prize within thirty (30) days.
If a winner does not wish to claim the prize but wishes to donate it to MAP Foundation for the benefit of Kentucky Children’s Hospital and Woodhill Community Center, the winner shall provide MAP Foundation with a written statement within the thirty (30) day period stating that the winner wishes to donate the prize to MAP Foundation for the benefit of Kentucky Children’s Hospital and Woodhill Community Center. A prize winner shall not donate the prize back to MAP Foundation if to do so would violate KRS 238.540(7).
If a raffle winner does not claim the prize or donate it to MAP Foundation within thirty (30) days after having been contacted, MAP Foundation shall notify the Office of Charitable Gaming and draw another ticket in the presence of office personnel. The tickets shall remain under the control of MAP Foundation until a winner is identified and accepts the prize.
The car, when selected, will be transferred to the Grand Prize winner in "AS IS, WHERE IS" condition by Lexus of Lexington. MAP Foundation, Kentucky Children’s Hospital, and Woodhill Community Center do not provide any guarantee or warranty, expressed or implied, in connection with the car. MAP Foundation accepts no liability or responsibility regarding the manufacturing or condition of the car. No warranties, express or implied, are made or offered by MAP Foundation, Kentucky Children’s Hospital, or Woodhill Community Center.
The value of the 2020 Lexus ES 350 is approximately $44,988. The Internal Revenue Service or the Kentucky Franchise Tax Board will accept that value of the car or any other value for the purpose of determining any income tax that may be payable by the Grand Prize winner.
All raffle ticket sales are final. No refunds will be made, except any ticket request with verified payment received after 2,000 tickets have been sold or after the deadlines set forth hereinabove will be returned. No other refunds are available. MAP Foundation assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A raffle participant's sole and exclusive remedy for MAP Foundation’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, Woodhill Community Center or their respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
TICKETS: Tickets are $100.00 each and may be purchased solely from MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, Woodhill Community Center or their agents. You may buy as many tickets as you wish, subject to availability, until a maximum of 2,000 tickets are sold. Each raffle ticket will be entered separately in the drawing. Each raffle ticket is a separate and equal chance to win the 2020 Lexus ES 350.
To order tickets by mail, download a ticket request form from www.lexusoflexington.com/raffle, or obtain a ticket request form by calling 1.859.335.8361, X 104, or send a SASE to MAP Foundation, 1999 Richmond Road, Suite 300, Lexington, KY 40502. Ticket requests must include payment or credit card information to be eligible. Send completed forms with payment or credit card information to MAP Foundation, Lexus Raffle, 1999 Richmond Road, Suite 300, Lexington, KY 40502.
To request tickets by fax, send the form to 859.335.0110. For credit card payment, your ticket number(s) will be sent to you by US mail or email; the ticket stubs will be completed with your contact information and placed in the drawing container. Fax requests must be received before 5:00 PM EDT March 6, 2020 Eastern Time. All sales are final. If the credit card transaction is denied for any reason or your check does not clear the bank, no ticket shall be sold and the ticket purchase request is null and void. The purchaser will be notified immediately of the problem and the next ticket order in line will be processed.
When a raffle ticket order is placed and funds have cleared, MAP Foundation will complete the raffle ticket for the purchaser by filling in the name, address, email and phone number of the purchaser. MAP Foundation will then place each completed raffle ticket stub in a secured location at the offices of MAP Foundation in Lexington, Kentucky, and mail or email the ticket(s) to the purchaser. When possible, the purchaser will receive an email from MAP Foundation confirming the ticket purchase and providing the ticket number(s).
TICKET AND PAYMENT VERIFICATION
MAP Foundation reserves the right to reject any ticket request form that is submitted with payment that does not constitute "good funds." All defective or physically altered request forms are subject to disqualification at the discretion of MAP Foundation. Prior to the Grand Prize drawing, MAP Foundation will make a reasonable effort to notify any individual whose payment has been rejected or who submits a defective or altered entry form, that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline.
GRAND PRIZE WINNER: Winner notification will be made by telephone, mail and posted on the web page. The winner will need to provide proper identification to the satisfaction of MAP Foundation. A representative of MAP Foundation will assist in coordinating all the details with the winner regarding the delivery, tags and registration of the 2020 Lexus ES 350. Winner agrees to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital and Woodhill Community Center and agrees to sign a publicity release without any further compensation.
PRIZE AWARDS IN EVENT OF NON-SELLOUT OF TICKETS
A maximum of 2,000 tickets will be sold. If fewer than 2,000 raffle tickets are sold, MAP Foundation reserves the right, in its absolute discretion, to postpone the date of the drawing until a date that is within seven (7) days from the date on which 2,000 tickets have been sold. MAP Foundation reserves the right to cancel this raffle contest at any time, in which event liability is limited to the refund of the ticket price to all participants.
REGISTRATION WITH THE STATE OF KENTUCKY
This raffle is conducted for the benefit of KENTUCKY CHILDREN’S HOSPITAL AND WOODHILL COMMUNITY CENTER by The MAP Foundation, Inc., and licensed by the Office of Charitable Gaming, License Number ORG 0002332.
