These Official Rules & Regulations govern the conduct of the Lexus for The Little Ones 2024 Raffle (the “Raffle”) and, together with the decisions of THE MAP FOUNDATION, INC (hereinafter “MAP Foundation”), are binding on everyone who purchases a Raffle ticket and/or who is named on a Raffle ticket. The Raffle of a 2024 Lexus RX 350 Premium is a fundraising activity conducted by MAP Foundation in support of KENTUCKY CHILDREN’S HOSPITAL, WOODHILL COMMUNITY CENTER AND OTHER CAUSES SELECTED BY THE MAP FOUNDATION BOARD OF DIRECTORS. These Official Rules & Regulations may not be waived, modified or supplemented unless such waiver, modification or supplementation is made in writing by MAP Foundation.
GRAND PRIZE DRAWING
The Grand Prize drawing for the Raffle of a 2024 Lexus RX 350 Premium will be held at Lexus of Lexington, 1264 East New Circle Road, Lexington, KY 40505, on Sunday, March 24th, 2024 at 4PM Eastern, except this date and all other dates stated in these Rules may be extended at the absolute discretion of MAP Foundation. In the event the Raffle is postponed, all reasonable efforts will be made to notify ticket holders of the new drawing date. Online ticket orders must be received before 12:00 Noon EDT Sunday, March 24, 2024. Tickets may sell out before that time. The drawing will be conducted under the supervision of MAP Foundation. The winning ticket will be drawn at random from a drum containing all eligible Raffle tickets.
PRIZE AWARDS IN EVENT OF NON-SELLOUT OF TICKETS
The price per ticket is $100.00 and may be purchased exclusively online from MAP Foundation at the following website: https://littleonesraffle.com/. A maximum of 2,500 tickets will be sold. Ticket sales will cease when the maximum number of qualified entries is reached. Any requests and payments received following the cut off time or after the sale of 2,500 tickets will be returned to the sender. If fewer than 2,500 Raffle tickets are sold, MAP Foundation reserves the right, in its absolute discretion, to postpone the date of the drawing until a date that is within seven (7) days from the date on which the maximum 2,500 tickets have been sold. The ratio of prizes to tickets is a maximum of 1 to 2,500 if all tickets are sold. Employees, Directors, and Officers of The MAP Foundation, Inc., are not eligible to participate. MAP Foundation reserves the right to cancel this Raffle contest at any time, in which event liability is limited to the refund of the ticket price to all participants.
GRAND PRIZE
The Raffle winner will receive a 2024 Lexus RX 350 Premium in the color of their choice based on availability. MAP Foundation does not undertake to give advice on the legal or tax consequences of the Raffle or its winner. However, it understands that the IRS position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and, consequently, do not qualify as deductible charitable contributions.
The Grand Prize winner assumes and must pay all fees and charges (including, but not limited to, tags, tax and license), income taxes, local, state and federal taxes when the car is transferred to the winner. In addition, all costs of car ownership, such as (without limitation) insurance, are the Grand Prize winner's sole responsibility. MAP Foundation assumes no responsibility for The Grand Prize winner's tax obligations and suggests you consult your tax advisor. Forms W-2G & 941 will be filed with the Internal Revenue Service to report the value of the prize won. The winner will also receive a copy of these forms. This offer is void where prohibited by law; and all federal, state and local laws and regulations apply.
The Grand Prize winner is strongly advised to seek professional legal or tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner, including, without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. The Grand Prize of a 2024 Lexus RX 350 Premium is to be purchased at Lexus of Lexington, Lexington, Kentucky. Depictions of the car shown in informational materials on the Internet can be found at www.lexusoflexington.com or elsewhere. The 2024 Lexus RX 350 Premium shown in photos may be only representative of the Grand Prize; actual cars may be viewed at Lexus of Lexington, 1264 E. New Circle Road, Lexington, Kentucky 40505.
By participating in this Raffle, all ticket purchasers and the person named on each Raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by MAP Foundation for publicity purposes and naming of the Grand Prize winner to be published in area newspapers or other media including television, radio, web and print. The Grand Prize winner will be published on The MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, and Woodhill Community Center websites. The name of the winner may be obtained by sending a written request plus a self-addressed, stamped envelope to The MAP Foundation, Inc., 1999 Richmond Road, Suite 300, Lexington, KY 40502. MAP Foundation’s interpretation and application of the Rules and Regulations shall be final.
By participating in this Raffle, each participant releases MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, and Woodhill Community Center and each of their respective members, directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind, including, but not limited to, liability for injuries, losses, or damages arising from or caused by any prize or resulting from acceptance, possession, use or misuse of any prize; and each winner agrees to indemnify and hold MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, Woodhill Community Center and each of their respective members, directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of any prize.
ELIGIBILITY
Raffle is open to the general public, and ticket purchasers and the person named on a Raffle ticket must be at least 18 years of age at the time of purchase. The Grand Prize winner may be required to sign an affidavit of eligibility. Employees, Directors and Officers of The MAP Foundation, Inc., are not eligible to participate. Offer void where prohibited by law.
In order for the Grand Prize winner to receive the car (subject to the other provisions in these Rules), the Grand Prize winner must elect to receive the car by delivering written notice of that election to MAP Foundation, by April 30, 2024. If MAP Foundation is unable to notify the winner in person or by telephone, it shall notify the winner by certified mail within seven (7) days of the drawing that the winner shall claim the prize within thirty (30) days.
If the Grand Prize winner does not wish to claim the prize but wishes to donate it to MAP Foundation for the benefit of Kentucky Children’s Hospital, Woodhill Community Center and other causes selected by the MAP Foundation Board of Directors, the winner shall provide MAP Foundation with a written statement within the thirty (30) day period stating that the winner wishes to donate the prize to MAP Foundation for the benefit of Kentucky Children’s Hospital, Woodhill Community Center and other causes selected by the Board of Directors. A prize winner shall not donate the prize back to MAP Foundation if to do so would violate KRS 238.540(7).
If the Grand Prize winner does not claim the prize or donate it to MAP Foundation within thirty (30) days after having been contacted, MAP Foundation shall notify the Department of Charitable Gaming and draw another ticket in the presence of Department personnel. The tickets shall remain under the control of MAP Foundation until another Grand Prize winner is identified and accepts the prize.
The car, when selected, will be transferred to the Grand Prize winner in "AS IS, WHERE IS" condition by Lexus of Lexington. MAP Foundation, Kentucky Children’s Hospital and Woodhill Community Center do not provide any guarantee or warranty, expressed or implied, in connection with the car. MAP Foundation accepts no liability or responsibility regarding the manufacturing or condition of the car. No warranties, express or implied, are made or offered by MAP Foundation, Kentucky Children’s Hospital or Woodhill Community Center.
CAR VALUE
The value of the 2024 Lexus RX 350 Premium is approximately $58,570.00 The Internal Revenue Service or the Kentucky Franchise Tax Board will accept that value of the car or any other value for the purpose of determining any income tax that may be payable by the Grand Prize winner.
REFUNDS
All Raffle ticket sales are final. No refunds will be made, except any ticket request with verified payment received after 2,500 tickets have been sold or after the deadlines set forth hereinabove will be returned. No other refunds are available. MAP Foundation assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A Raffle participant's sole and exclusive remedy for MAP Foundation’s breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital, Woodhill Community Center or their respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
TICKETS
Tickets are $100.00 each and may be purchased exclusively online from MAP Foundation at the following website: https://littleonesraffle.com/.
You may buy as many tickets as you wish, subject to availability, until a maximum of 2,500 tickets are sold. Each Raffle ticket will be entered separately in the drawing. Each Raffle ticket is a separate and equal chance to win the 2024 Lexus RX 350 Premium.
GRAND PRIZE WINNER
Winner notification will be made by telephone, email or US mail and posted on the web page. The winner will need to provide proper identification to the satisfaction of MAP Foundation. A representative of MAP Foundation will assist in coordinating all the details with the winner regarding the delivery, tags and registration of the 2024 Lexus RX 350 Premium. Winner agrees to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by MAP Foundation, Lexus of Lexington, Kentucky Children’s Hospital and Woodhill Community Center and agrees to sign a publicity release without any further compensation.
REGISTRATION WITH THE STATE OF KENTUCKY
This Raffle is licensed by the Department of Charitable Gaming and is conducted by The MAP Foundation, Inc., License Number ORG 0002332, for the benefit of KENTUCKY CHILDREN’S HOSPITAL, WOODHILL COMMUNITY CENTER AND OTHER CAUSES SELECTED BY THE MAP FOUNDATION BOARD OF DIRECTORS.
